I've been avoiding this whole thing for ages now because legal stuff isn't in my interests or forte at all, but I just gave in and read up to find out what all the fuss was about.
JKR is awesome. She's obviously done her research and, from that article, seems to have the upper hand. RDR sound ignorant. I hope she wins, because it's true, losing will have soo many negative ramifications for our fandom and others too.
I skimmed through those excerpts of the Harry Potter Lexicon on justia.com and OMG! What a piece of crap. JKR is right 100%, there is no new information in it, no analysis, no commentary – no real work done. It just reorganises everything we already know in the books. Anyone obsessed enough and with enough time would have come up with it easily.

Ms. Rowling at court Tuesday. “A fan’s affectionate enthusiasm should not obscure acts of plagiarism,” she said in a message.
Thank you Joanne. It's her work, period. I wonder if that guy is a closeted H&HR trying to cash in because he didn't get his way in DH.
You never know...

Here is what came of it: A U.S. judge on Monday halted publication of an unofficial encyclopedic companion to the popular Harry Potter book series in a copyright case author J.K. Rowling argued would threaten other authors.
Judge Robert Patterson in U.S. District Court in Manhattan wrote an opinion that said independent U.S. book publisher RDR Books "had failed to establish an affirmative defense of fair use" and that publication of "The Harry Potter Lexicon" should not proceed. You can read more from Reuters - Judge halts unofficial Harry Potter lexiconI've to say that I liked of the result. Not because I'm a fan of the JK's work, but because of the real arguments. I know that started sometime ago, but I think it's nice to see the end of it.
